Harmonising data protection law and assigning EU-wide competence to a national public authority reduces the costs of the companies affected and creates a level playing field. The design and the number of the powers conferred upon the Commission are not acceptable in terms of the division of powers. The rules regarding the invalidity of the consent are insufficiently concrete; moreover, here, too, the necessity to process healthcare data should be taken into account. The rules regarding employee data protection do not serve legal certainty.
