The EU Commission’s proposed reform of the EU Energy Agency ACER and the creation of additional organisations aims to improve regulation of cross-border electricity networks and the wholesale electricity market. cep criticises the Commission’s proposals.

Status

In cep’s view, establishing regional operational centres (ROCs) for example, is in breach of the principle of proportionality. In addition, cep’s energy experts criticise the fact that decisions in the ACER Board of Regulators are to be made by simple majority which contradicts ACER’s mandate of promoting cooperation between the national regulatory authorities. ACER’s extensive final decision-making power on all cross-border regulatory issues is also in breach of settled CJEU case law.
